A Local Law to amend the administrative code of the city of New York, in relation to establishing a residence privacy protection program for city elected officials

Summary

This bill would require each City agency privacy officer to administer a residence privacy protection program to allow the Mayor, Comptroller, Public Advocate, Borough Presidents, and Council Members to request agencies to not disclose their home address outside City government. An agency would be allowed to disclose: (i) under exigent circumstances; (ii) if the elected official approves in writing; (iii) if disclosure is required by federal or state law or court order; (iv) if the agency asserts in good faith a need to disclose; or (v) if disclosure is related to a law enforcement investigation. An agency must submit an explanation to its privacy officer if it disclosed for the reason in (i) and the elected official must be notified. An agency must submit a waiver request to its privacy officer to disclose for the reasons in (iii), (iv), and (v) and the privacy officer must notify the elected official of the waiver. The program covers agency contractors and subcontractors.
