Summary

This bill would prohibit contracting agencies from restricting a human services contractor from submitting an invoice solely because a budget modification is pending on that contract. Where a budget modification is pending, the contractor would be permitted to continue submitting invoices for allowable costs, and the contracting agency would be required to process and pay undisputed amounts on such invoices on the timeline required by the Procurement Policy Board rules. The bill would also require contracting agencies to act on a pending budget modification within 15 business days and to provide written notice stating the specific basis for any denial or request for revision. Finally, the bill would require the City Chief Procurement Officer to submit an annual report to the Council on budget modification activity for covered contracts.
