No. 445 ..Title Resolution calling on the New York State Senate to pass, and the Governor to sign, S.7585-A/ A.10137 authorizing mobile barber shops to be licensed in the State ..Body By Council Members Maloney, Louis and Morano Whereas, Individuals who seek to own, control or operate a barber shop in New York State must obtain a barber shop license from the Department of State; and Whereas, New York General Business Law section 438 prohibits individuals from running a barber shop in a non-permanent location such as a trailer or recreational vehicle; and Whereas, The high cost of commercial rent in New York City may be a barrier to barbers who wish to establish a small business; and Whereas, It is appropriate for individuals to provide barber services from a properly equipped trailer, van or recreational vehicle; and Whereas, In 2021, New Jersey passed legislation legalizing mobile barbershops and hair salons; and Whereas, Assembly bill A.10137, introduced by Assemblymember Jordan Wright and passed by the New York State Assembly, and its companion bill S.7585-A, introduced by Senator Cordell Cleare and pending in the New York State Senate, would amend General Business Law section 438 to authorize mobile barber shops so long as the vehicles have proper layouts, adequate equipment and sanitary conditions; and Whereas, S.7585-A/A.10137 would give small business owners a new way to deliver barber services to consumers in a safe and accessible manner, now, therefore, be it, Resolved, That the Council of the City of New York calls on the New York State Senate to pass, and the Governor to sign, S.7585-A/ A.10137 authorizing mobile barber shops to be licensed in the State.
