THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 1756 ..Title Resolution approving a motion to file pursuant to withdrawal of the application regarding the decision of the City Planning Commission on Application No. N 210262 ZRM, for an amendment of the text of the Zoning Resolution (L.U. No. 837). ..Body By Council Members Salamanca and Moya WHEREAS, Soma 142, LLC, filed an application pursuant to Section 201 of the New York City Charter, for an amendment of the text of the Zoning Resolution of the City of New York, modifying Appendix F for the purpose of establishing a Mandatory Inclusionary Housing area, utilizing Options 1 and 2, which in conjunction with the related action would facilitate the would facilitate the proposed development of a 17-story residential building with 81 residential units, 21 of which would be permanently affordable units, in the West Harlem neighborhood of Manhattan Community District 9 (ULURP No. N 210262 ZRM) (the "Application"); WHEREAS, the City Planning Commission filed with the Council on August 23, 2021, its decision dated August 18, 2021 (the "Decision"), on the Application; WHEREAS, the Application is related to application C 210261 ZMM (L.U. No. 836), a zoning map amendment to change an existing R6A District to an R9A District; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on September 10, 2021; and WHEREAS, by submission dated September 23, 2021 and submitted to the Council on September 23, 2021, the Applicant withdrew the application. RESOLVED: The Council approves the motion to file pursuant to withdrawal in accordance with Rules 7.90 and 11.60(b) of the Rules of the Council. Adopted.
