A Local Law to amend the administrative code of the city of New York, in relation to requiring notice of electronic monitoring of employees
Summary
The proposed legislation would require employers who engages in electronic monitoring of employees to provide written notice to each employee who may be subject to electronic monitoring. Such notice would be required to list all the forms and methods of electronic monitoring that employees may be subject to, as well as the types of information obtained by each form or method of electronic monitoring. Employers would also be required to conspicuously post the notice at the workplace. Violations would be subject to civil penalties of $500 for the first offense, and for subsequent violations that occur within two years of any previous violation, a civil penalty up to $1,000 for the second violation and up to $3,000 for each succeeding violation.
